Video Transcript: How Does a Court Determine Spousal Support?

>>Question: How does the court determine spousal support?

>>Ohio Attorney Jeff Hawkins:  The Ohio Revised Code has various factors that the court looks at in fashioning a spousal support award. It looks at the lengths of the marriage. That’s the main factor. The court looks at trying to equalize the income of the parties as far as taking a consideration of parties’ income and their fixed expenses. Once that is considered by the courts, the court will fashion a spousal support award. As a general rule, and you won’t find this anywhere in any case law or any statute, one year spousal support for every three years of marriage.
